Medicaid Estate Recovery: State Strategies to Mitigate Harm
Justice in Aging will hold a webinar discussing Medicaid estate recovery and state strategies to strengthen protection.
Federal law requires states to seek repayment for certain Medicaid benefits from an individual's remaining property after they die through a process known as estate recovery. Because Medicaid enrollees have limited incomes and few assets, the primary source of collection is often the family home, which can have negative impacts on surviving family members.
Despite these federal requirements, states have options to limit the scope of collection and strengthen protections for families. Justice in Aging will provide an overview of Medicaid estate recovery, as well as insight into recent state mitigation efforts that offer opportunities for advocates to advance similar changes in their own states.
